DISCUSSION ON IMPROVMENTS AND ASSESSMENTS ON DAVEPORT STREET
 
Background
As part of the Pavement Management Program (PMP) the City is scheduled to do a partial reconstruction of Davenport from 105th Ave. south to 101st  Ave. this year.  Our assessment policy calls for assessing commercial properties 50% of the cost of the improvements.     
 
As part of the Davenport improvements the National Sports Center (NSC) is proposed to be assessed approximately $169,000 for the partial reconstruction.  The NSC had initially indicated to the City that they do not have to pay an assessment because they are a State agency.  Further research has indicated that the City has the right to assess the NSC, however the NSC has the ability to decide how much they benefit from the improvements and can tell the City how much of the assessment they will pay.
 
In additional discussions with the NSC they have indicated that they do not have the resources to pay the assessments for the Davenport Improvements and indicated that when 105th is improved they will go to the State Legislature to request funds for the project through the bonding bill.
 
The question for the City Council is does the City proceed with the Davenport reconstruction project knowing that we will not receive the $169,000 in assessments for the NSC property and that it may not ever receive the full amount?
 
The PMP program does have funds to cover this amount as Davenport is part of the MSA road system and we will receive funds from the State.  However, not receiving the assessments will impact the bottom line of the PMP and affect how many future projects the City will be able to do.
 
Our Engineering Staff is ready to send the project out for bids and needs to know whether to continue with this project or to postpone/cancel it.
 
Recommendation
Staff recommendation is that Davenport is in poor condition and it is a major service road serving our residents and businesses that the project should be done this year.
