RECEIVE PETITION AND ORDER PREPARATION OF FEASIBILITY REPORT FOR TRUNK UTILITY IMPROVEMENTS TO SERVE THE NORTH HALF OF THE NORTHEAST QUARTER OF SECTION 23 AND THE PLAT OF GLENN MEADOWS, IMPROVEMENT PROJECT NO.  14-14
 
Background
A petition dated December 17, 2014, has been submitted to the City requesting public utility improvements to serve the North Half of the Northeast Quarter of Section 23 and the plat of Glenn Meadows abutting Lexington Avenue and 109th Avenue.  The petition is signed by 41.9% of the frontage of real property.  Pulte Homes (aka Centex Homes) and Alliance Bank are petitioning to have utilities brought to their parcels at the northwest corner of 109th Avenue and Lexington Avenue (plat of Glenn Meadows).  The utilities would come from the Pheasant Ridge Drive area.  It is recommended that the City Council receive the petition and order preparation of a Feasibility Report.
 
Recommended Council Action
By motion, approve the Resolution.
 
Body
WHEREAS, the Blaine City Council has received a petition dated December 17, 2014, requesting local improvements be extended north of 109th Avenue to serve the North Half of the Northeast Quarter of Section 23 and the plat of Glenn Meadows, both areas abutting Lexington and 109th Avenues; and
 
      WHEREAS, the local improvements are described as follows:
 
      Trunk and lateral sanitary sewer and trunk and lateral water main.
 
      AND WHEREAS, the determination of petitioners percentage is based on frontage of real property abutting Lexington and 109th Avenues.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
 
1.      The petition is hereby declared to be signed by 41.9% of the frontage of real property.  This declaration is made in conformity to Minnesota Statutes, Chapter 429.035.
 
2.      The proposed improvements are hereby referred to the City Engineer and she is instructed to report to the City Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvements are necessary, cost-effective, and feasible, and as to whether they should best be made as proposed or in connection with some other improvement, and the estimate cost of the improvement as recommended.
 
3.      The petitioners shall provide a cash escrow in the amount of $4,000 for the cost of the report.
