APPROVE FIRST ADDENDUM TO WELLHEAD PROTECTION IMPLEMENTATION JOINT POWERS AGREEMENT
 
Background
Cities were required by the Minnesota Department of Health (MDH) and Minnesota Rule ยง4720.5130 to prepare wellhead protection plans for their community water supplies.  Anoka, Blaine, Centerville, Circle Pines, Coon Rapids, Fridley, Lexington, Lino Lakes, Ramsey and Spring Lake Park (the Cities) entered into a Wellhead Protection Joint Powers Agreement (JPA) with Anoka County in 1997 for purposes of developing the required plans.  Once plans were approved, the Cities were required by the MDH to implement their wellhead protection plans for their community public water supplies.  Some implementation items were best accomplished through cooperative efforts, and therefore the Cities determined it was in their best interests to implement those common elements of the wellhead protection plans jointly, utilizing efficient and cost-effective cooperation among members.  Anoka County, committed to enhancing water resources protection and public health, found it in its interest to facilitate the joint efforts of the Cities.  Therefore, on October 21, 2010, City Council approved the Wellhead Protection Implementation Joint Powers Agreement with the Cities and County, via Resolution No. 10-132.  The agreement's objectives include implementing common elements of the Cities wellhead protection plans, establishing a joint user group to address activities related to the agreement, and authorizing the County to act as facilitator and as agent contracting for any consultant services or applying for any grants, to allocate costs, and receive and disburse grants, yet still allow cities to opt out of a joint implementation task if it did not affect them or they had already addressed that item through other means.
 
The First Addendum to the Wellhead Protection Implementation Joint Powers Agreement is being presented at this time to include cities in Anoka County that did not enter into the Implementation JPA, specifically Andover, Columbus, Coon Rapids, East Bethel, Ramsey and St. Francis.
 
Recommendation
By motion, approve the resolution.
 
Body
WHEREAS, the Cities of Anoka, Blaine, Centerville, Circle Pines, Fridley, Lexington, Lino Lakes and Spring Lake Park (Member Cities) entered into a Wellhead Protection Joint Powers Agreement in 1997 for the purpose of jointly preparing wellhead protection plans for their community water supplies; and
 
WHEREAS, on or about September 15, 2010 the Member Cities entered into a Wellhead Protection Implementation Joint Powers Agreement (JPA) to comply with the requirements of the Minnesota Department of Health to implement their wellhead protection plans for their community public water supplies and to protect their well water supply for their communities; and
 
WHEREAS, the cities of Andover, Columbus, Coon Rapids, East Bethel, Ramsey and St. Francis (Joining Cities) wish to be part of the Wellhead Protection Implementation JPA; and
 
WHEREAS, paragraph 2.2 of the Wellhead Protection Implementation JPA provides that additional cities may join the Agreement following the effective date.  If a city joins after the effective date, that city is responsible for its proportionate share of any expenses incurred in implementing the Agreement for which the city will receive a benefit; and
 
WHEREAS, paragraph 14.2 of the Wellhead Protection Implementation JPA requires that any amendments to this Agreement be made in writing; and
 
WHEREAS, Wellhead Protection Implementation JPA First Addendum allows the Joining Cities to become a part of the Wellhead Protection Implementation JPA.
 
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:
 
 
1.      The Wellhead Protection Implementation Joint Powers Agreement First Addendum between the County of Anoka and the Cities of Andover, Anoka, Blaine, Centerville, Circle Pines, Columbus, Coon Rapids, East Bethel, Fridley, Lexington, Lino Lakes, Ramsey, Spring Lake Park and St. Francis is hereby approved.
 
2.      The Mayor and City Manager are hereby authorized and directed to execute said Agreement First Addendum.
