VACATION OF DRAINAGE AND UTILITY EASEMENT FOR
LOT 14, BLOCK 2, THE SANCTUARY EIGHTH ADDITION VACATION NO. V12-01
 
Background
The Public Hearing was conducted on April 19, 2012. No questions from the public were received. The drainage and utility easement is being vacated because the easement covered a wetland that was filled and mitigated as a part of The Sanctuary 8th Addition in 2006. The applicant is a single property owner who represents 100% of the affected property abutting this easement.  The Engineering Department and the Coon Creek Watershed District have reviewed this request and concur with the vacation.  This lot is within the physical boundary of the Rice Creek Watershed, but since the majority of The Sanctuary project is in the Coon Creek Watershed boundary, Coon Creek has the administrative jurisdiction for the project.  The Rice Creek Watershed District has also concurred with the vacation.
 
Ordinance No. 12-2250 was introduced for first reading at the April 19, 2012 Council meeting and is presented at this time for adoption.

THE CITY OF BLAINE DOES ORDAIN:  Chapter 195 is adopted as an Ordinance of the City of Blaine to read: (Added portions are underscored and deleted portions are shown in brackets with overstrike.)
 
Chapter 195       -  Vacation of Drainage and Utility Easement
 
195.01 -  That Part of Lot 14, Block 2, THE SANCTUARY EIGHTH ADDITION, Anoka County,  Minnesota, described as follows:
 
Beginning at the northeast corner of said Lot 14; thence South 64 degrees 05 minutes 40 seconds West (assumed bearing) along the northwesterly line of said Lot 14 a distance of 75.87 feet; thence South 49 degrees 34 minutes 47 seconds East a distance of 58.48 feet; thence North 65 degrees 30 minutes 34 seconds East a distance of 52.40 feet; thence North 25 degrees 54 minutes 20 seconds West a distance of 54.85 feet to the point of beginning. Except the northwesterly and northeasterly 10 feet of said lot 14.
 
 
195.02  -  Said vacation has been made after Notice of Public Hearing in conformance with Minnesota Statutes and pursuant to Chapter 12, Section 12.06, of the City Charter of the City of Blaine.
