Background

Public and written notice has been provided as required by City Charter. A petition dated March 15, 2017, was submitted to the City by Dale Rhoads representing DWR Holdings, LLC requesting vacation of drainage and utility easement in Lot 1, Block 1, Ludel Addition.  This vacation is being requested so the existing sanitary sewer can be rerouted along the north edge of the property to allow for construction of a new commercial building. The applicants represent 100% of the affected property abutting this easement.  The Engineering Department has reviewed this request and concurs with the vacation.

Body

WHEREAS, the City Council has received a petition dated the 15th day of March, 2017, requesting vacation of drainage and utility easement in Lot 1, Block 1, Ludel Addition; and

 

WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 18th day of May 2017, at which time all persons desiring to be heard were given an opportunity to be heard.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The vacation of drainage and utility easement in Lot 1, Block 1, Ludel Addition is hereby approved as described:

A 30 foot utility easement over, under and across all that part of Lot 1, Block 1, Ludel Addition, City of Blaine, Anoka County, Minnesota described as follows:

 

Commencing at the northeast corner of said Lot 1; thence South 00 degrees 09 minutes 02 seconds West, assumed bearing, on the east line of said Lot 1, a distance of 260.48 feet; thence South 89 degrees 57 minutes 43 seconds West, 25.00 feet to a point 25.00 feet westerly of, measured perpendicular to the east line of said Lot 1, said point also being the point of beginning; thence South 89 degrees 57 minutes 43 seconds West, 344.04 feet to a point on an arc lying 10.00 feet northeasterly of, measured radially from the easterly line of Ulysses Street NE per said Ludel Addition; thence northwesterly 54.65 feet on a curve concave to the southwest, not tangent with last described line, said curve has a radius of 210.00 feet, a central angle of 14 degrees 54 minutes 37 seconds, the chord of said curve bears North 56 degrees 38 minutes 09 seconds West, 54.49 feet; thence North 89 degrees 57 minutes 43 seconds East, not tangent with last described curve, 389.63 feet to a point 25.00 feet westerly of, measured perpendicular to the east line of said Lot 1; thence South 00 degrees 09 minutes 02 seconds West on said line, 30.00 feet to the point of beginning.
