Title
CONSIDER APPROVAL OF A THERAPEUTIC MASSAGE ENTERPRISE LICENSE FOR ACKERMAN ACUPUNCTURE, 2331 108TH LANE NE, BLAINE (FORMERLY MASSAGE OFF CENTRAL)
Background
Mike Ackerman, owner and applicant of Ackerman Acupuncture, has submitted an application for a Therapeutic Massage Enterprise license for 2331 108th Lane NE (former Massage Off Central). The applicant has submitted a license application, the license and background fee, and all other required documentation, including certificate of liability and worker’s compensation insurance. The Blaine Police Department is in the process of conducting a background investigation on the individuals and any license would not be issued until a successful background is received.
The applicant has provided the city with a purchase agreement from Lori Brouillette, owner of Massage Off Central, who will be retiring and wishes to sell her location. While City code states the number of enterprise licenses shall not exceed 10 it also provides for the transfer of a license in good standing as outlined below:
Sec. 22-431. - License restrictions.
(c) Transfer of license prohibited. The license issued is for the person or the premises named on the approved license application. No transfer of a license shall be permitted from place to place or from person to person without complying with the requirements of an original application. Transfer of ownership of a current licensed therapeutic massage enterprise in good standing may be applied for but does not ensure approval of a new therapeutic massage enterprise. The council is not required to issue the full number of therapeutic massage enterprise licenses that it has available.
If approved the total number of enterprises will be 18. While the goal is to reach a maximum number of 10 licenses through attrition, Council reviewed such license transactions at a recent workshop and confirmed direction that an enterprise in good standing could be eligible for approval.
Recommendation
By motion, approve a Therapeutic Massage Enterprise License for Ackerman Acupuncture, located at 2331 108th Lane NE, contingent upon a successful background investigation and certificate of occupancy.
