Executive Summary

Classic Holdings East, LLC, is requesting to release a development agreement from the title for the Parkside North development. The Parkside North development agreement no longer applies to Outlot A, Parkside North 9^th Addition.

The City is requested to release specific lots from recorded development agreements on a fairly regular basis. In this instance, the property owner has requested that the City release Outlot A, Parkside North 9^th Addition from the recorded development agreement for Parkside North.

The parcel to be released is for an outlot that is proposed to be sold. All the development agreement responsibilities for this parcel have been met and the outlot can be released.

In order to release the Development Agreement, the City Council must adopt a resolution that authorizes the Mayor and City Clerk execute all necessary documents.

WHEREAS, Outlot A, Parkside North 9^th Addition, is subject to a recorded Development Agreement and;

WHEREAS, the property owner has requested the City to release said lot from the recorded development agreement recorded as Document No. 530001.004 Torrens (recorded April 24, 2015) and;

WHEREAS, the City has determined that there are no outstanding development issues related to said lot and therefore no further purpose for the agreements.

NOW, THEREFORE, BE IT RESOLVED, that the Blaine City Council authorizes the Mayor and City Clerk to execute all necessary documents releasing said Development Agreement for the following described property:

Outlot A, Parkside North 9^th Addition
