RECEIVE PETITION AND ORDER PUBLIC HEARING FOR VACATION OF DRAINAGE AND UTILITY EASEMENT, EAST 34’ OF LOT 1 AND ALL OF LOT 2, BLOCK 1, WALLACE WOODS, VACATION NO. V16-03

 

Background

A petition dated October 12, 2016, was submitted to the City by Donald Krueger requesting vacation of drainage and utility easements over portions of Lot 1 and Lot 2, Block 1, Wallace Woods.  This vacation is being requested in order to allow for the adjustment of a lot line, which was approved by Council on June 16, 2016.  New easements will be dedicated along the new property line.  The applicants represent 100% of the affected property abutting this easement.

Recommendation

By motion, adopt the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 12th day of October, 2016, requesting vacation of easements for utility purposes granted in the plat of Wallace Woods; and

 

                     WHEREAS, the Engineering Department has reviewed the petition and recommends that the City Council hold a Public Hearing on the requested vacation.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The Council will consider the petitioned vacation of easements for the property owner.

 

2.                     A Public Hearing shall be held on the proposed vacation at 8:00 PM on the 17th day of November, 2016, and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
