Background

The City Council approved a Preliminary Plat for Oakwood Ponds (Excelsior Group) at the October 19, 2017 city council meeting. One of the parcels contained within the plat was the Biskey property at 4919 125th Avenue. The preliminary plat indicated that the parcel owned by Biskeys would be split at the ditch line with the Excelsior Group purchasing the north portion (shown as Parcel A) and the Biskeys retaining the south portion (shown as Parcel B) with their home and buildings.

 

The developer and the Biskeys would like to close on the property, however the Final Plat for this area is not yet ready to be processed. Both parties have asked the City to prepare and approve a resolution (Waiver of Platting) approving the new lot line consistent with the preliminary plat. Once this resolution has been approved it can be provided to the County and the Biskeys can close with the developer and sell the north portion of their property. 

 

The recommended approval has a couple of conditions consistent with how property is final platted:

                     The north parcel (Parcel A) that will be purchased by Excelsior Group to be combined at Anoka County with one of the other adjacent parcels now owned by the Excelsior Group.

                     The south parcel (Parcel B) that will be retained by Biskey is to be included in the Final Plat for this area and re-platted as a Lot and Block as originally intended in the approved preliminary plat.

 

Park dedication will be handled for Parcel A at the time it is Final Platted. Parcel B will have park dedication requirements if it is ever subdivided and redeveloped in the future. 

 

Recommendation

By motion, approve the Resolution.

                     WHEREAS, an application has been filed by Greg Biskey and the Excelsior Group as Waiver of Platting Case No. 17-0053 and;

 

                     WHEREAS, said case involves the division of a parcel into two separate lots, Anoka County, Minnesota, described as follows:

 

CURRENT DESCRIPTION

The East Half of the East Half of the Southwest Quarter of the Southeast Quarter of Section 1, Township 31, Range 23, excepting therefrom Parcel 5, ANOKA COUNTY HIGHWAY RIGHT-OF-WAY PLAT NO. 50, Anoka County, Minnesota.

 

PROPOSED PARCEL A

That part of the East Half of the East Half of the Southwest Quarter of the Southeast Quarter of Section 1, Township 31, Range 23, Anoka County, Minnesota, lying northerly of the following described line:

 

Commencing at the Northwest corner of said East Half of the East Half of the Southwest Quarter of the Southeast Quarter; thence South 00 degrees 10 minutes 23 seconds East, assumed bearing along the West line of said East Half of the East Half of the Southwest Quarter of the Southeast Quarter, a distance of 548.50 feet to the point of beginning of the line to be described; thence South 44 degrees 17 minutes 21 seconds East, 467.86 feet to the East line of said East Half of the East Half of the Southwest Quarter of the Southeast Quarter and said line there terminating.

That part of the East Half of the East Half of the Southwest Quarter of the Southeast Quarter of Section 1, Township 31, Range 23, Anoka County, Minnesota, lying southerly of the following described line:

Exepting therefrom Parcel 5, ANOKA COUNTY HIGHWAY RIGHT-OF-WAY PLAT NO. 50, Anoka County, Minnesota.

 

                     WHEREAS, the Blaine Planning Commission has reviewed this subdivision as part of a Preliminary Plat on September 12, 2017; and

 

                     WHEREAS, the Blaine Planning Commission has recommended said Preliminary Plat be approved; and

 

                     WHEREAS, the City Council of the City of Blaine has reviewed said case on October 19, 2017 and December 7, 2017; and

 

          WHEREAS, the City Council finds that the requested Waiver of Platting for 4919 125th Avenue (Biskey) is consistent with the previously approved Preliminary Plat of Oakwood Ponds.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Waiver of Platting per Section 18-9(B)(2) of the Subdivision Ordinance is hereby granted to Greg Biskey and Excelsior Group, allowing them to record the above described lot division with the Anoka County Recorder’s Office, based on the following conditions:

 

1.                     The north parcel (Parcel A) that will be purchased by Excelsior Group to be combined at Anoka County with one of the other adjacent parcels owned by the Excelsior Group.

 

2.                     The south parcel (Parcel B) that will be retained by Biskey is to be included in the Final Plat for this area and re-platted as a Lot and Block as originally intended in the approved preliminary plat of Oakwood Ponds.

 

3.                     The Mayor, City Manager and City Clerk are hereby authorized to execute any and all documents necessary for the recording of this Waiver of Platting.
