Approve Joint Powers Agreement No. C0008410 with Anoka County for Rehabilitation of County State Aid Highway 12 (109th Avenue)

 

Executive Summary

Anoka County has been working on a mill and overlay project to rehabilitate County State Aid Highway 12 (109th Avenue) from Flanders Court to County State Aid Highway 17 (Lexington Avenue) for the 2021 construction season.  To facilitate an agreement and reimbursement for the county project to incorporate turn lane improvements to the benefit of the North Meadows development a Joint Powers Agreement is needed as the county is unable to directly charge the development.  The city and developer have also agreed that this cost will be removed from the developer’s escrow for the North Meadows development for the construction of the turn lane improvements.    

 

Background

During the design process for the mill and overlay project of 109th Avenue, North Meadows development submitted their project to the county for review.  The county has required the construction of turn lanes on 109th Avenue at the new access of Okinawa Street.  The County, City and Developer met to review the timing and when/how the turn lane improvements and rehabilitation project would be constructed.  It was determined that the county would add the construction of the turn lanes to their mill and overlay project.  As the county does not have a way to recover the costs of adding the turn lanes directly from the developer, they asked to enter into a Joint Powers Agreement (JPA) with the city. The city will in turn enter into an agreement with the developer to pay for the improvements.  The County is moving the project forward and has added the construction of the turn lanes to the North Meadows development access as part of the project. 

 

The estimated construction cost of the total project is approximately $821,000.  Anoka County has prepared a JPA based on the County’s cost participation policy.  The City is being asked to pay for a portion of the construction cost plus 12% for construction engineering expenses. The total estimated construction cost to the City is $25,678.  Adding the 12% construction engineering to the City’s share of the construction cost brings Blaine’s estimated total to $28,759.36.  This cost will be paid for by the North Meadows development.  The developer has agreed to these costs and there are sufficient funds in the developer’s escrow.

Financial Impact

There is no financial impact to the city.  The costs outlined in the JPA will be passed on to the developer of the North Meadows development.

Body

                     WHEREAS, the County of Anoka and the City of Blaine desire to jointly rehabilitate a section of County State Aid Highway 12 (109th Avenue) from Flanders Court to County State Aid Highway 17 (Lexington Avenue) in accordance with Anoka County and the Minnesota Department of Transportation standards for the benefit of the traveling public; and

 

                     WHEREAS, Minnesota Statutes Section 471.59 authorizes the County of Anoka to enter into an Agreement with the City of Blaine to provide for the rehabilitation of County State Aid Highway 12 (109th Avenue) from Flanders Court to County State Aid Highway 17 (Lexington Avenue) for the joint exercise of powers common to each; and

 

                     WHEREAS, said Agreement details the responsibilities of the County of Anoka and the City of Blaine as to the costs associated with the design, construction and related activities of the project.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     Joint Powers Agreement No. C0008410 between the County of Anoka and the City of Blaine with regard to the rehabilitation of a section of County State Aid Highway 12 (109th Avenue) from Flanders Court to County State Aid Highway 17 (Lexington Avenue) is hereby approved.

 

2.                     The Mayor and City Manager are hereby authorized and directed to execute said agreement.
