Background
Woodland Development is proposing to final plat nine detached townhome lots as a part of the plat Woodland Village 6th Addition. The original approval from 2006 required the exterior building material standards to be specific to the original home builder Kootenia Home's product. Woodland Development is proposing to continue the cottage style construction and meet the standards of that original approval with the exception of the requirement of Hardi-board siding. Woodland has requested to be allowed to build with premium grade steel horizontal siding, vinyl shakes and cultured stone.
 
This CUP amendment request is therefore similar in context to the amendment approved by the City Council on August 5, 2010 to allow similar exterior material changes for the larger lot single family homes and also a CUP Amendment granted in October 2010 for the detached townhomes that have already been platted within the Woodland Village Development. There are no changes to the finished floor area requirement of 1500 square feet above grade.
 
The existing homeowners within the Woodland Village development, as well as adjacent property owners were notified of this request.
 
Recommendation
By motion, approve the Resolution.

WHEREAS, an application for amendment has been filed by Woodland Development as Conditional Use Permit Amendment Case File No. 14-0005; and
 
WHEREAS, the Blaine City Council has reviewed said case on February 20, 2014.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit amendment is hereby approved per Section 29.80 of the zoning ordinance to allow for construction of nine (9) detached townhomes in a DF (Development Flex) zoning district based on the following conditions:
 
The adoption of this resolution amends Resolution No. 06-92, only as it pertains to standards for the 9 detached townhome lots contained in Lots 1-9, Block 1; Woodland Village 6th Addition. Future phases of detached townhomes (Outlot A, Woodland Village 6th Addition) will require separate CUP review and conditions as part of the subdivision process for those future lots.
 
Single Family-Detached Townhomes (Villas) - DF Development Standards (9 units)
 
Permitted Uses
1.      Single-family detached dwellings.
2.      Group family daycare.
 
Accessory Uses
1.      Private garages.
2.      Private swimming pools/meeting the requirements of Blaine Municipal Code Chapter 18, Article IX.
3.      Keeping of not more than two (2) boarders and/or roomers per dwelling unit.
 
Conditional Uses
1.      Home occupations listed as Conditional Uses fewer than 33.11.
 
Standards
1.      Construction of all detached townhomes to be generally guided by depictions, drawings and information submitted for review and approval for this conditional use permit amendment.  All site plans and unit plans require approval of the Planning Department prior to work beginning.  All site work to meet the Performance Standards Section 33.00 of the Zoning Ordinance. Exterior materials to consist of .24 gauge horizontal steel siding or other approved alternative, vinyl shakes, shutters, enhanced window trim, and cultured stone or brick.
2.      Minimum floor area above grade for detached townhomes must be 1,500 square feet.
3.      All units to be placed according to the following minimum building setbacks:
v      25-foot front yard setback for houses and garages
v      5-foot side yard setback for garages
v      7.5-foot side yard setback for houses
v      30-foot rear yard setback for houses and garages
4.      All garages to contain a minimum of 400 square feet with no dimension less than 20 feet. Maximum garage area limited to not more than 880 square feet.
5.      No detached accessory structures except for those associated with or required for operation and maintenance of swimming pools.
6.      Each lot shall provide one boulevard overstory tree and two yard trees consisting of either overstory or conifer trees.
7.      All unit foundations to have a minimum of 12 foundation plantings along front of home.
8.      All lots shall have underground irrigation.  
9.      All entrance monument signage to be approved by a separate permit.  
10.      All homes within 500 feet of Lexington Avenue (Lots 1-5), to incorporate the Noise Abatement Standards with Central Air conditioning to mitigate noise impacts.
11.      Developer to execute and record, if deemed appropriate by the City Engineer, with the sale of each single family lot, an affidavit indicating to homebuyers that the soils located in the rear and side yards of the single family lots have not been corrected to accommodate general building construction or pools and that additional effort may be required, by the homeowner, to stabilize those soils before additional construction could occur.
12.      It shall be required that all yards of a new single-family dwelling be sodded over a minimum of 4 inches of topsoil (black dirt containing not more than 35 percent sand).
13.      All lot landscaping requirements to be contained within an executed SIPA (Site Improvement Performance Agreement) and covered by an appropriate financial guarantee.
