Background
The applicant took over the veterinary outpatient clinic at 625 County Road 10 NE in 2007. The applicant has been operating under the name of Companion Veterinary Hospital.
 
The applicant was not aware of the Conditional Use Permit requirements prior to purchasing the building in 2007.  However, after doing some follow-up with the City, the applicant was made aware of the CUP requirements.  The applicant has spent the last several years trying to establish the business and would like to have an additional two (2) years to complete the required improvements of fire sprinkling and parking lot improvements including concrete curb and gutter, establishing a 10 foot side yard parking setback, and additional landscaping as shown on attached site plan.  These improvements were required in the existing Conditional Use Permit to be completed one year after the original applicant (Dr. Karl Wall) purchased the property or October 31, 2007, whichever event occurred first.
 
It is the long-term goal of the City to maintain a viable business community and volunteer fire department through the installation of automatic fire extinguishing systems.  Therefore, it is recommended the applicant be required to install a fire sprinkler system and make the required site improvements by October 31, 2012 (a one year extension) rather than the 2013 date requested by the applicant. This extension provides an additional one year time period to the already 7 years allowed since the original CUP was approved in 2004.
 
The City has a matching grant program to help cover the costs of installing fire suppression in existing buildings. The details of the grant were reviewed with the applicant in 2009 and again just recently as part of this request. The applicant has indicated they do not have sufficient funds to provide the match at this time
 
Recommendation

PER SECTION 30.14 (a) OF THE ZONING ORDINANCE
OF THE CITY OF BLAINE
 
WHEREAS, an application has been filed by Companion Veterinary Clinic/Carlos Gandara, DVM and Sharyl Gandara as conditional use permit amendment Case File No. 07-59; and
 
WHEREAS, the Blaine City Council has reviewed said case on October 7, 2004, June 7, 2007, October 16, 2008, November 5, 2009 and November 3, 2011.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit amendment is hereby approved per Section 30.14 (a) of the Zoning Ordinance to extend the deadlines for installation of fire sprinklers and parking lot improvements at 625 County Road 10 NE based on the following conditions:
 
1.      No boarding of animals is permitted with the exception of animals held for observation or additional medical procedures.
      
2.      No outside kennels or permanent exercise areas.  
 
3.      No cremation or disposal of dead animals is allowed on the premises.
 
4.      Installation of an automatic extinguishing system is required by October 31, 2012.
 
5.      Ventilation should be forced air type, not a wall ventilation fan.
 
6.      The rear entry door should be solid-core.
 
7.      All signage requires a separate permit.
 
8.      The holding kennel room should be soundproofed in the walls and ceiling to limit noise transmission to 65 dB measured on the outside of the exterior wall.
 
9.      This conditional use permit acknowledges the variance granted on June 5th, 2003 to Pioneer Engineering for a 10-foot variance to a portion of the west property line as shown within the report.
 
10.      The applicant to construct improvements including concrete curb and gutter, establishing a 10 foot side yard parking setback, and additional landscaping as shown on attached site plan.  These improvements to be completed by October 31, 2013.
 
11.      The applicant to provide a plan indicating how Conditions 4 and 10 will be completed, including a financing plan, within six (6) months of the adoption of this Resolution.
 
12.      The previous Conditional Use Permit Resolution #09-139 will become null and void with the adoption of Resolution #11-152.
