Background
Notice for this second public hearing has been published and mailed.  Resolution No. 12-018 of the Blaine City Council, adopted on February 16, 2012, ordered the reconstruction of Davenport Street improvement with the stipulation that a contract be awarded no later than February 15, 2013.  A contract has not yet been awarded to allow time for the National Sports Center to obtain funds for their pending assessments.  Therefore, this second public hearing is being held, the improvements will be reordered, and the date to award a contract will be extended an additional two years with approval of the proposed resolution.
 
As presented at the first public hearing, the proposed improvements include construction of right turn lanes at 104th Avenue, 103rd Avenue, and entrance to the National Sports Center, and total concrete curb and gutter replacement, spot concrete sidewalk replacement, new concrete sidewalk, storm sewer structures, asphalt pavement replacement, traffic control signage, signal modification, striping, and related appurtenant construction from 99th Lane to 105th Avenue.  The estimated cost is $1,148,200, of which $499,000 is proposed to be assessed over a ten-year period.  Replacement of existing sanitary sewer castings/rings and relocation of hydrants at an estimated cost of $23,220 is proposed to be paid for by the City Public Utility Fund.  The remaining portion of $625,980 is proposed to be paid from the City's Municipal State Aid Street funds and the City's Pavement Management Program funds.  The project is necessary, cost-effective, and feasible and will result in a benefit for the properties proposed to be assessed.

Recommendation
Conduct second public hearing and, by motion, approve the resolution.
 
Body
WHEREAS, Resolution No. 12-018 of the Blaine City Council, adopted on February 16, 2012 , ordered the reconstruction of Davenport Street improvement with the stipulation that a contract be awarded no later than February 15, 2013; and
 
WHEREAS, the contract has not yet been awarded and therefore a second public hearing on the matter was scheduled and the date to award a contract will be extended an additional two years; and
 
WHEREAS, the required notices were published and mailed to benefiting property owners, and the second public hearing was held on the 7th day of February, 2013, at which time all persons desiring to be heard were given an opportunity to be heard.
 
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:
 
1.      Such improvements are hereby reordered as proposed in the Feasibility Report, which was accepted by Resolution No. 12-010 adopted on the 19th day of January, 2012.
 
2.      The contract shall be awarded no later than February 7, 2015.
