Executive Summary
The City received a petition dated April 7, 2022 from RPSLegacy 108 Prop LLC, requesting the vacation of the section of public right-of-way on 123rd Avenue NE, east of Ulysses Street and west of Trunk Highway 65; according to the recorded plat thereof, Anoka County, Minnesota, as shown in Exhibit A (attached).
Background
The property was originally a part of Lot 1, Block 1, Blaine Square and the section of public right-of-way is no longer required by the city. Adjoining properties to the north and the south are proposed for future development. Engineering staff has reviewed the request and is in agreement with the vacation.

WHEREAS, the City Council has received a petition dated the 7th day of April, 2022, requesting vacation of the public right-of-way on 123rd Avenue NE, east of Ulysses Street and west of Trunk Highway 65; and
WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 6th day of June, 2022, at which time all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
The vacation of the section of public right-of-way on 123rd Avenue NE, east of Ulysses Street and west of Trunk Highway 65; according to the recorded plat thereof, Anoka County, Minnesota.
All that part of 123rd Avenue as dedicated in the plat of BLAINE SQUARE, which lies easterly of a line which is parallel with and 40 feet easterly of the centerline of Ulysses Street as dedicated in said plat of BLAINE SQUARE and which lies westerly of the westerly right of way line of State Trunk Highway No. 65. Containing 19,202 square feet or 0.44082 acres, more or less, is hereby approved.
