Executive Summary

Due to the resolution for approval of the Conditional Use Permit (CUP) for Reliable Garage Door not being approved, the request is denied. Therefore, a written statement of denial should be approved.

Background

Staff report prepared by Sheila Sellman, City Planner

The City of Blaine Charter requires four affirmative votes for every ordinance or resolution. At the April 4, 2022 City Council meeting, a motion was made to approve a resolution of approval for a Home Occupation CUP for Reliable Garage door located at 11662 Lexington Avenue (PC22-0010). The motion did not receive four affirmative votes therefore it failed, and the CUP was not approved.

Staff consulted with the City Attorney regarding the appropriate process following the denial. In order to formalize the denial, a written statement of denial should be approved. The persons voting for the CUP would simply be agreeing that these are the reasons the persons voting against, voted that way. It is not a statement agreeing with those reasons.
