Approval of Blaine 35 Phase Two Tax Increment Financing (TIF) Development Agreements

Executive Summary

Artis is preparing to start construction on Buildings B and C as part of the Blaine 35 project. Tax Increment Financing (TIF) development agreements are required prior to the start of construction.

Background

In 2021, Artis received approvals to construct three industrial buildings totaling 317,000 square feet. The site is located at 85th Avenue/35W. As part of the development approval, an economic development tax increment financing (TIF) district was approved to assist project financing due to unique, extraordinary site development costs. Two separate TIF districts were created because of the project being done in two different phases.

Phase one consists of a 118,500 multi-tenant office/manufacturing/warehousing building. Necessary TIF documents were executed for this project in 2021 prior to the start of construction last fall. Two companies have executed leases for space in Building A. Those companies are Jonco Die Company and Caerus Corporation. Jonco Die Company is a manufacturer specializing in steel rule cutting dies and related tooling for the packaging industry. Jonco will be occupying 51,800 square feet of Building A. Caerus Corporation is a medical device company specializing in orthopedic and pain management technologies for both human and veterinary patients. Caerus will be occupying 34,477 square feet of Building A. There is approximately 32,000 square feet of space still available in Building A.

Phase two consists of Buildings B and C. Building B is approximately 98,900 square feet and Building C is approximately 100,000 square feet. Site grading was completed last fall and the developer is ready to start construction of buildings this spring. Building C is already fully leased by Chandler Industries. Chandler Industries is a precision machining manufacturer specializing in the aerospace, defense, and medical device markets. They are consolidating two locations and this location will be their corporate headquarters with over 140 jobs in skilled labor, management, and executive level positions. Building B is still available for lease.

Two separate TIF development agreements are required for Buildings B and C. Attached are the draft agreements. The following are general requirements of the developer/EDA outlined in the documents.

•                     Minimum Improvements: Construction of a 100,000 and 98,900 square foot buildings.

•                     Start Date: On or before June 1, 2022

•                     Completion Date: On or before August 1, 2023

•                     Job Creation Requirement: Building B, 30 full-time jobs; Building C, 100 full-time jobs. When combining it with the 59 jobs required for Building A, the total amount required for the project is 189 jobs. It’s anticipated the overall project will exceed this. Jobs are required to be created within two years of building completion. The developer is required to provide the EDA information annually on the job creation and wages until the requirement is fulfilled.

•                     Developer shall construct project to be consistent with all approved plans.

•                     EDA shall reimburse the developer for development costs by issuance of a TIF note of up to Building B, $838,341 for Building B and $816,986 for Building C. This will be in the form of pay-as-you-go (PAYGO) financing.

Strategic Plan Relationship

Development of this site as proposed is consistent with the strategic priority of Successful Development of the 35W Corridor.

Board/Commission Review

No board or commission review is required.

Financial Impact

TIF dollars provided to the developer are created as a result of this specific development. General property taxes from other taxpayers or other city funds are not the source of TIF dollars. The agreement is structured as a PAYGO, meaning the developer will not receive TIF dollars unless they complete the project, therefore there is no financial risk to the city, nor is the city obligated to pay the developer if they do not perform and/or taxable values are below projections.

Staff Recommendation

By motion, adopt the attached resolution.
