Background

Staff report prepared by Elizabeth Showalter, Community Development Specialist

Zoning

The property is zoned B-2 (Community Commercial). Moving truck rental is a conditional use in the zoning district.

Surrounding Zoning and Land Uses

The properties north and south of the subject property are zoned B-2 and guided Community Commercial. The properties across Baltimore Street are zoned I-1 (Light Industrial) and guided Light Industrial.

Existing Conditions

The 0.9 acre parcel has an existing 6,220 square foot office building.

History

The building was originally constructed in 1989 as a batting cage facility. CUPs have been previously granted for recreation and construction/contractors offices. Both CUPs are void since the uses have been discontinued for over a year. Site plan approval was issued in 2017 (SP17-0019) for the construction of two concrete pads connected to the parking lot. At that time, the applicant did not indicate the parking lot expansion would be used for moving trucks. The applicant is now applying for the necessary CUP to allow that use.

Evaluation of Request

Site Plan

No site changes are proposed as part of this request. The applicant is proposing to continue storing the trucks on the existing concrete pads.

The 6,200 square foot building requires 21 parking stalls based on a mixture of bank (1/400) and office (1/200) uses, with 1,400 square feet excluded for restrooms and mechanical equipment. Currently 21 stalls are located on the site. No additional parking is necessary

Landscaping

The site meets current landscaping requirements and no tree removal is proposed.

Grading/Storm Drainage

The proposed storage of moving trucks will not require any additional grading or modification to the existing storm water drainage for the site/property.

Wetlands/Watershed

Given that the proposed storage of moving trucks will not require any additional grading or modification to the existing storm water drainage for the site/property, and that there was not a large disturbance for the construction of the existing parking pads, a watershed permit is not required.

Access/Street Design

The site/moving trucks will utilize the existing access drive to Baltimore Street NE. No additional access will be granted.

Conditional Use Permit

Section 27.04 Criteria for granting conditional use permits:

The Blaine City Council shall consider the advice and recommendations of the Planning Commission and the effect of the proposed use on the comprehensive plan and upon the health, safety, and general welfare of occupants of surrounding lands. Among other things, the Council shall consider the following findings where applicable. (Ord. No. 20-2447, 7-20-2020)

1.                     The use shall not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. The proposed use does not increase the burden on parks, schools, streets, or utilities.

2.                     The use will be located, designed, maintained, and operated to be compatible with adjoining properties and the existing or intended character of the zoning district. The use is accessory to an office use and is compatible with the adjacent commercial and industrial uses.

3.                     The use shall have an appearance that will not have an adverse effect upon adjacent properties. A condition has been included that the trucks must be parked against the building to reduce the visual impact.

4.                     The use, in the opinion of the City Council, shall be reasonably related to the overall needs of the City and to the existing land use.

5.                     The use shall be consistent with the purposes of the zoning code and purposes of the zoning district in which the applicant intends to locate the proposed use. The use is consistent with the purpose of the zoning code and the purpose of the district to provide services for the local area.

6.                     The use shall not be in conflict with the comprehensive plan of the City. The use is consistent with the comprehensive plan designation to provide services to neighborhoods or at a regional scale.

7.                     The use will not cause traffic hazard or congestion. The proposed development will not result in any additional traffic hazards or additional congestion to the area.

8.                     The use shall have adequate utilities, access roads, drainage and necessary facilities. The proposed development, as constructed, will have the required utility services, adequate roads and necessary drainage facilities to service the proposed development.
