Executive Summary

Council is asked to ratify and approve the LELS Local 477 Deputy Chief labor agreement.

Background

Law Enforcement Labor Services (LELS) organized a bargaining unit consisting of one individual - the Deputy Chief.  The parties reached agreement on the labor contract covering the three years beginning May 13, 2021 through December 31, 2023. The May date reflects that the bargaining unit was not in existence until this date.

1.                     Wages were set in a pay plan that provides for a starting wage rate, a top pay rate after one year, and a wage adjustment of 3% thereafter through 2023.

2.                     An annual increase of $50 per month, per year to the City’s monthly contribution to the cafeteria plan.

3.                     The Deputy Chief position is exempt, meaning they are not eligible for overtime pay for additional hours worked. As such, areas commonly found in collective bargaining agreements related to overtime are not in this agreement.

4.                     As this is a bargaining unit of one, provisions surrounding seniority are not applicable. Instead, it is addresses probation and recall if  a lay-off is to occur.

5.                     The general nonunion benefit program as related to time off is consistent with all non-union and union employees, with the exception that the city agrees to meet and negotiate should it replace the sick and vacation plan with a paid-time off (PTO) plan.

6.                     Consistent with past practice, the city will continue to provide a uniform for the Deputy Chief.

The balance of the agreement contains general provisions such as grievance, discipline, management and union rights, injury on duty, and POST Board license fees and are consistent with current union and non-union provisions.

Strategic Plan Relationship

This item relates to the organizational health strategic plan priority to recruit and retain quality employees as dictated by the current labor market.
