Title

RIGHT OF WAY AND UTILITY EASEMENT ACQUISITION AT 12256 LEXINGTON AVENUE

Background

During the construction of Water Tower #4 and the watermain connecting it to the water system, a 50 foot wide right of way and utility easement was purchased from the property owner at 12256 Lexington Avenue.  This easement was sufficient to install and maintain the watermain connecting Water Tower #4 to the water system but was short of the planned 80 foot wide right of way that would be needed to install a future roadway (Zest Street) which would run from 125th Avenue to the future extension of Lakes Parkway.

In 2018 the city had to obtain a 30 foot temporary easement from the property owner adjacent to the existing 50 foot easement to facilitate construction of the Trunk Watermain and Trunk Sanitary Sewer for the NE Area Wellfield Project.  Upon completion of the project, the property owner approached staff with a desire to sell the city the additional 30 feet of easement to complete the needed 80 foot wide right of way and utility easement.

The 40 acre property immediately north of the city water tower and treatment plant is actively being marketed for development and with the impending construction of Water Treatment Plant #4, obtaining the additional 30 foot right of way and utility easement from a willing seller will be of benefit to the City and assist in the orderly development of the 40 acre parcel to the north.

An appraisal was done and a price of $50,000.00 was negotiated with the property owner.

Zest Street from the future extension of Lakes Parkway to 125th Avenue has been identified as a State Aid Route and funding for this easement acquisition would be through State Aid Street Improvement Funds.

Recommendation

By motion, authorize the Mayor and City Manager to acquire the remaining 30 foot of right of way easement, for the future Zest Street extension, from the property owner at 12256 Lexington Avenue, Charles Georgi, in the amount of $50,000.
