Title

AUTHORIZE CITY MANAGER TO AMEND THE AGREEMENT WITH RICE CREEK WATERSHED DISTRICT FOR THE CITY OWNED PROPERTY AT 12260 LEXINGTON AVENUE

Background

At the June 7, 2018 City Council meeting, council authorized an agreement between the City of Blaine and Rice Creek Watershed District to clean up outstanding issues on the city owned parcel at 12260 Lexington Avenue.  These issues relate to Rice Creek Watershed District (RCWD) rules and the construction of Water Tower 4 in 2008 and a gravel road to Well 19 that was constructed in 2016.  These two items were not done in compliance with RCWD rules and as a result, RCWD required that the city agree to come into compliance with the rules prior to issuance of a permit to construct the Northeast Area Trunk Watermain and Sanitary Sewer project that was awarded on May 17, 2018.  The agreement allowed the city to receive a permit for the watermain and sanitary sewer project upon signing the agreement and then work toward meeting the compliance requirements in the agreement during the process of constructing Water Treatment Plant 4 (WTP4).

The original agreement identified November 27th, 2020 as the date by which compliance must be met; this coincided with the planned final completion date of WTP4.  During final plan preparation, the city’s consultant engineers hired a water treatment plant contractor who was not going to bid on the WTP4 project to do a construction feasibility review of the plans prior to bidding.  One area that the contractor identified that would result in substantial savings to the city was in extending the completion date to September 30, 2021.

Staff approached RCWD staff to inquire if an amendment to the original agreement reflecting a new completion date was acceptable to the district.  RCWD has prepared an amendment to the agreement which changes the date of compliance to September 30, 2021.

Recommendation

By motion, authorize the City Manager to sign the amendment to the Agreement with Rice Creek Watershed District for the City owned property at 12260 Lexington Avenue.
